In May 2025, Congress passed the TAKE IT DOWN Act. The new law makes it a federal crime to create and distribute deepfake pornography, legally known as Non-Consensual Intimate Imagery (NCII).

Under the new law:

Online platforms must remove NCII and any copies within 48 hours, or face serious penalties.

But here’s the challenge: most NCII goes undetected unless it’s reported. And by the time it’s flagged, the damage may already be done.

We’ve attached a free report to summarize the implications of the new law. But first, here’s 5 ways platforms can stay ahead:

1. Prevention Is Cheaper Than Penalties.

Under the new law, platforms that fail to remove NCII and its' copies within 48 hours are subject to:

  • Federal Trade Commission (FTC) investigation.

  • $53,000 per violation.

  • Criminal Liability for repeat violations.

  • Exponentially severe penalties if a minor's likeness is used.

You don’t need thousands of bad uploads to go bankrupt — just a handful. Automated safeguards are far less costly than reactive cleanup.

2. Two Days Means You Need Tools, Not Triage.

With just 48 hours to remove reported content, platforms need reliable, scalable workflows. Manual processes aren’t fast enough. A solution that automates detection ensures you don’t miss critical violations under pressure.

3. Proactive Detection Is Now the Standard.

The law puts the onus on proactive detection. Waiting for users to report content isn’t a legal defense anymore. Platforms must demonstrate that they have systems in place to identify NCII independently.

4. Safety Is A Competitive Edge.

Trust is now a differentiator. Platforms that invest in real, transparent safety measures, especially around emerging threats like AI-generated abuse, are better positioned to retain users, partners, and advertisers.

5. Automated Detection = Sustainable Compliance.

Peak's AI-powered NCII detection tool helps platforms scan and flag harmful content in real time, reducing manual load and protecting your platform at scale. As the only AI deepfake pornography detector trained on real deepfake pornography, it's designed to meet the specific demands of the TAKE IT DOWN Act — so you stay ahead, not behind.
